Terms and Conditions for Waste Collection Belgravia
These Terms and Conditions set out the basis on which Waste Collection Belgravia provides waste collection and related services to residential and commercial customers in the United Kingdom. By placing a booking, making a payment, or allowing our operatives to access your premises, you agree to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions:
Customer means the person, business or organisation ordering or receiving waste collection services.
Company, we, us or our means Waste Collection Belgravia.
Services means any waste collection, removal, clearance, loading, transportation, disposal, recycling or related services provided by us.
Waste means any materials, rubbish, junk or items presented for collection in connection with our Services, excluding prohibited items as set out in these terms.
Service Area means the locations within which we agree to provide waste collection, including but not limited to Belgravia and surrounding areas, as determined by us from time to time.
2. Scope of Services
We provide waste collection and associated services for domestic and commercial customers within our Service Area. The precise scope of the Services will be agreed at the time of booking, including the type and estimated volume of waste, the collection address, service date, and any special requirements notified to us and accepted by us.
We reserve the right to refuse collection of any waste that is unsafe to handle, not as described at the time of booking, or is prohibited under applicable waste regulations. We may also refuse or suspend service where access is unsafe or impracticable, or where providing the Services would put our staff, contractors or members of the public at risk.
3. Booking Process
Bookings for waste collection services may be made by telephone or by any other method we make available. At the time of booking, you will be asked to provide accurate information about:
The collection address and any access restrictions or parking limitations.
The type of waste to be collected, including any bulky items, electrical goods or construction materials.
The approximate volume or weight of waste.
Preferred dates and times for collection within our operating hours.
You are responsible for ensuring that all information supplied at the time of booking is complete and accurate. Our quotation and service capacity are based on the details you provide. If, on arrival, the actual waste or access conditions differ materially from those described, we may adjust the price, revise the booking, or decline to carry out some or all of the Services.
A booking is only confirmed when we have accepted your request and, where applicable, received the required payment or deposit. We reserve the right to decline any booking at our discretion.
4. Service Times and Access
We will use reasonable efforts to carry out the Services on the agreed date and within the agreed time window. However, any time estimates given are approximate and are not guaranteed. Factors such as traffic, weather conditions, operational issues, and delays at previous collections may affect our arrival time.
You must ensure that we have safe, reasonable and lawful access to the premises and to the waste to be collected, including suitable parking or loading space where required. Any permits, authorisations or access arrangements needed to enable our vehicles and staff to operate legally and safely are your responsibility, unless otherwise agreed in writing.
If we are unable to gain access or complete the collection due to circumstances within your control, we may charge a call-out fee or a proportion of the agreed fee to cover our costs.
5. Customer Responsibilities
You must segregate and present waste in accordance with our instructions and any applicable local or national regulations. Unless we agree otherwise, all waste must be ready for collection at the agreed time, properly contained and reasonably accessible.
You agree not to include hazardous or prohibited materials in your waste unless we have expressly agreed to handle such items in compliance with relevant regulations. Prohibited materials include, but are not limited to, asbestos, clinical or medical waste, biological waste, certain chemicals, solvents, gas bottles, explosives, highly flammable materials, and any substances that may present a significant health or safety risk.
You confirm that you either own the waste or are authorised by the owner to arrange its removal and disposal. You indemnify us against any claim brought by the owner of the waste or by any third party in respect of the removal or disposal of such waste, except to the extent caused by our negligence or breach of these terms.
6. Pricing and Quotations
Prices for our Services may be provided as fixed quotations or estimates, depending on the information available at the time of booking. Quotations are generally based on the type and estimated volume of waste, ease of access, and any additional services requested.
If, on arrival, the actual volume or nature of waste, or the access conditions, differ from those stated at the time of booking, we may adjust the price accordingly. You will be informed of any change in price before additional work is carried out and you will have the option to accept the revised price or decline the additional service.
All prices are provided in pounds sterling and are inclusive or exclusive of VAT as stated at the time of booking. If VAT is applicable, it will be charged at the prevailing rate.
7. Payments
Payment terms will be confirmed at the time of booking. Unless otherwise agreed, payment is due either in full at the time of booking or immediately upon completion of the Services.
We accept payment by the methods we notify to you, which may include card payment, bank transfer or cash, subject to any limits or conditions we may impose. We reserve the right to require payment in advance or to request a deposit for larger or more complex collections.
Where payment is not received by the due date, we may suspend further services and charge interest on overdue amounts at the statutory rate or at such rate as permitted by applicable law. You will be responsible for all reasonable costs incurred by us in recovering overdue amounts, including legal and collection fees.
8. Cancellations and Amendments
You may request to cancel or amend a booking by contacting us as soon as possible. Any cancellation or amendment is only effective when confirmed by us.
If you cancel a booking more than 24 hours before the scheduled collection time, any pre-paid amount may be refunded at our discretion, less any non-refundable costs incurred. If you cancel within 24 hours of the scheduled collection time, or if we attend the site and are unable to complete the Services due to circumstances within your control, we may retain all or part of the agreed fee to cover costs and lost time.
We reserve the right to cancel or reschedule a booking due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, safety concerns, or regulatory issues. Where we cancel, we will offer to reschedule the service or, if payment has been made and no services have been provided, issue a refund of the amount paid.
9. Waste Handling and Regulations
We operate in compliance with applicable UK waste management legislation and regulations. All waste collected is transported, treated, recycled or disposed of using appropriate and lawful methods, aiming to minimise environmental impact where reasonably practicable.
We may require you to provide information about the composition and source of waste, particularly where it may include controlled, restricted or regulated materials. You must provide accurate information to enable us to comply with relevant laws, including obligations relating to duty of care, carrier licensing, and appropriate disposal routes.
You agree to cooperate with any reasonable requests for documentation or information that may be required to demonstrate legal and compliant handling of waste. We may refuse to accept waste where we reasonably believe that handling, transporting or disposing of it would breach applicable laws or licence conditions.
10. Title, Risk and Disposal
Risk in the waste remains with you until it has been loaded onto our vehicle. Once waste has been collected and removed from your premises, title and responsibility for the waste will, where permitted by law, transfer to us or to our authorised contractors for the purposes of transportation and lawful disposal or recovery.
We may choose the disposal, recycling or recovery facility at our discretion, provided it operates in accordance with applicable regulations. We are not obliged to recover or return any items that have been removed as waste, except where expressly agreed in writing prior to collection.
11. Liability and Limitations
We will exercise reasonable care and skill in providing our Services. However, you acknowledge that waste collection and removal activities may involve movement of bulky or heavy items and vehicle operations in confined or residential areas.
We are not liable for any pre-existing damage to your property, fixtures, fittings or contents, or for damage that results from inherent defects, poor construction, or unsafe conditions. You are responsible for securing or removing any items that may be vulnerable to accidental damage during the collection process.
Our total liability for loss or damage arising from or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by you for the specific service giving rise to the claim, except where such limitation is not permitted by law.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
12. Indemnity
You agree to indemnify and hold us harmless from and against any claims, losses, damages, liabilities, costs and expenses arising out of or in connection with:
Your breach of these Terms and Conditions.
Your failure to comply with waste regulations or to provide accurate information about the nature of the waste.
Any claim by a third party relating to the ownership, removal or disposal of the waste, except to the extent such claim results from our negligence or breach of these terms.
13. Events Beyond Our Control
We are not responsible for any failure or delay in performing our obligations where such failure or delay results from events or circumstances beyond our reasonable control. These may include, without limitation, extreme weather, natural disasters, accidents, road closures, civil unrest, industrial action, epidemics, regulatory changes, or failure of utilities or communications networks.
If such an event occurs, we will take reasonable steps to resume the Services as soon as it is reasonably practicable to do so. Where prolonged disruption makes performance impracticable, either party may cancel the affected booking without further liability, and any pre-paid amounts for services not provided may be refunded at our discretion.
14. Data Protection and Privacy
We may collect and process personal data in connection with your booking and use of our Services, including contact details, service addresses and payment information. We will handle such data in accordance with applicable data protection legislation in the United Kingdom.
Your information will be used for purposes including managing bookings, providing services, processing payments, handling enquiries or complaints, and meeting our legal obligations. We may share your information with our employees, contractors and service providers to the extent necessary to deliver the Services, and with authorities where required by law.
15. Complaints
If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible with details of your complaint. We will investigate and respond within a reasonable timeframe, aiming to resolve the matter fairly and efficiently. Providing photographs or other evidence may assist in resolving disputes about service delivery or alleged damage.
16. Variations to These Terms
We may update or amend these Terms and Conditions from time to time. Any changes will apply to bookings made after the revised terms are published or otherwise communicated. The Terms and Conditions in force at the time of your booking will apply to that booking, unless a change is required by law or regulatory authority.
17. Severability
If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
18. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste collection services.
19. Entire Agreement
These Terms and Conditions, together with any written service confirmation or quotation provided to you, constitute the entire agreement between you and us in relation to the Services. You acknowledge that you have not relied on any statement, promise or representation that is not set out in these Terms and Conditions or in writing from us.
By confirming a booking, allowing access to your premises, or making payment for any of our Services, you confirm your acceptance of these Terms and Conditions.
